2. Educational Use Only
All BIOMED3D products are intended solely for educational, simulation, demonstration, and training purposes.
Products are not intended for human clinical use, diagnosis, treatment, or implantation into the human body.
Products may not be sterilized, reused clinically, or represented as medical devices unless explicitly stated in writing by BIOMED3D.
Customers and users are solely responsible for ensuring appropriate use of all products.
Customer assumes all responsibility for determining whether products are appropriate for their intended educational applications.

3. Custom Manufacturing
BIOMED3D products are manufactured on a made-to-order basis using additive manufacturing and related production processes.
Customer acknowledges and agrees that:
* Products are custom manufactured and are not mass-produced retail goods
* Production may begin immediately after order placement or project approval
* Custom design work, digital preparation, segmentation, and production time may be billable regardless of final project completion status once work has commenced
* Minor cosmetic, dimensional, coloration, translucency, texture, or finishing variations may occur as part of the manufacturing process
* Slight dimensional tolerances and fitment variations may occur between production runs and individual models
* Such variations are considered normal manufacturing characteristics and do not constitute defects
BIOMED3D reserves the right to determine whether any issue constitutes a manufacturing defect or normal product variation.

4. Orders and Payment
All orders are subject to acceptance and availability.
BIOMED3D reserves the right to refuse, limit, cancel, or reject any order at its sole discretion, including in cases involving suspected fraud, pricing errors, product availability issues, export restrictions, misuse of products, or violations of these Terms.
Customers are responsible for providing accurate shipping, billing, and contact information.
Electronic communications, quotations, invoices, approvals, and email confirmations shall constitute valid and enforceable business records and agreements between the parties.

5. Shipping and Risk of Loss
Title and risk of loss transfer to the customer upon delivery of products to the shipping carrier.
BIOMED3D is not responsible for:
* Carrier delays
* Customs delays
* Import duties or taxes
* Lost or stolen shipments
* Shipping damage occurring after transfer to the carrier
* Incorrect addresses provided by customer
Delivery dates are estimates only and are not guaranteed.

6. Returns and Refunds
All return and refund requests are governed by BIOMED3D’s Return Policy available on the website.
Due to the made-to-order nature of our products, all sales are generally considered final unless otherwise stated in writing.

7. Intellectual Property
All product designs, model geometries, renderings, digital files, photographs, branding, educational concepts, manufacturing methods, workflows, and related materials remain the exclusive intellectual property of BIOMED3D unless otherwise agreed in writing.
Customers may not reproduce, copy, scan, reverse engineer, distribute, commercially manufacture, or create derivative works based on BIOMED3D products or designs without prior written consent.
Submission of scans, reference files, or customer-provided materials does not transfer ownership of BIOMED3D proprietary manufacturing methods, workflows, or original design modifications.

8. No Warranty and Limitation of Liability
All products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, BIOMED3D disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
BIOMED3D does not guarantee educational outcomes, certification outcomes, procedural competency, clinical performance, or training success resulting from use of its products.
To the maximum extent permitted by law, BIOMED3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the website, products, or services.
BIOMED3D’s total liability for any claim shall not exceed the amount paid by the customer for the applicable order.

9. Force Majeure
BIOMED3D shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to natural disasters, supply shortages, labor disputes, equipment failures, shipping disruptions, governmental actions, pandemics, carrier delays, or material shortages.

These Terms shall be governed and interpreted under the laws of the State of California, without regard to conflict of law principles.

11. Dispute Resolution
Any dispute arising out of or relating to these Terms, the website, or products purchased from BIOMED3D shall first be attempted to be resolved through good-faith negotiations.
If unresolved, disputes shall be resolved exclusively through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
Customer waives any right to participate in class actions, class arbitrations, or representative proceedings.
